acomiadament es declarar\u00e0 improcedent si no existeix causa que justifiqui el cessament, acreditant la gravetat de la conducta del treballador o si no compleix amb els requisits establerts en la llei.<\/p>\n<p style=\"text-align: justify;\">La qualificaci\u00f3 de l&#8217; acomiadament improcedent per part d&#8217; un Jutge genera dues possibles situacions:<\/p>\n<ul style=\"text-align: justify;\">\n<li>Extinci\u00f3 del contracte amb el pagament d&#8217; una indemnitzaci\u00f3 per acomiadament.<\/li>\n<li>Continuaci\u00f3 de la relaci\u00f3 laboral reincorporant al treballador en el seu lloc de treball, en les mateixes condicions que tenia amb anterioritat a l&#8217; acomiadament.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">L&#8217; opci\u00f3 entre indemnitzaci\u00f3 o reincorporaci\u00f3 \u00e9s de l&#8217; empresari, llevat dels casos previstos per llei en qu\u00e8 ser\u00e0 el treballador qui opti per una de les dues opcions.<\/p>\n<p style=\"text-align: justify;\">[\/et_pb_text][et_pb_text _builder_version=\u00bb4.16&#8243; _module_preset=\u00bbdefault\u00bb background_color=\u00bb#FFFFFF\u00bb custom_padding=\u00bb||0px|||\u00bb global_colors_info=\u00bb{}\u00bb]<\/p>\n<p style=\"text-align: justify;\">Si l&#8217; acomiadament \u00e9s procedent, compleix amb els requisits i causes que la Llei permet, no hi ha obligaci\u00f3 de pagar indemnitzaci\u00f3 per acomiadament, per\u00f2 s\u00ed quitan\u00e7a.<\/p>\n<p style=\"text-align: justify;\">En funci\u00f3 de la causa que motivi l&#8217; acomiadament del treballador, ens podem trobar davant:<\/p>\n<ul style=\"text-align: justify;\">\n<li>Acomiadament disciplinari: Es produeix quan el treballador comet algun tipus de falta prevista a la Llei o al conveni col\u00b7lectiu d&#8217; aplicaci\u00f3.<\/li>\n<li>Acomiadament objectiu: Es produeix quan concorre alguna de les causes previstes a l&#8217; article 52 de l&#8217; Estatut dels treballadors.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Igualment, perqu\u00e8 un acomiadament objectiu es pugui entendre com a procedent, l&#8217; empresari haur\u00e0 de:<\/p>\n<ul>\n<li style=\"text-align: justify;\">Lliurar una comunicaci\u00f3 escrita al treballador explicant detalladament la causa del seu acomiadament i la seva raonabilitat.<\/li>\n<li style=\"text-align: justify;\">Posar a disposici\u00f3 del treballador una indemnitzaci\u00f3 equivalent a 20 dies per any treballat al mateix temps que la comunicaci\u00f3 escrita, a excepci\u00f3 de quan s&#8217; al\u00b7leguen causes econ\u00f2miques.<\/li>\n<li style=\"text-align: justify;\">Preav\u00eds de 15 dies des de la comunicaci\u00f3 escrita. En el cas de patir una discapacitat, es tindr\u00e0 dret a una llic\u00e8ncia de 6 hores setmanals per buscar una nova ocupaci\u00f3.
